Title: Amendment to the Constitution

Las Chupacabras - June 23, 2003 02:19 AM (GMT)
A proposed amendment to the Constitution, specifically to Articles III and IV.

1. If an office of the Cabinet should fall vacant in the period between elections, by vote of censure, resignation, or any other cause, Parliament shall elect a new person to that office within 7 days, unless the office falls vacant within 14 days of a general election.
2. Until the vacancy is filled by election, the Prime Minister may assign another Cabinet minister to perform the duties of that office, and he or she shall be the acting minister in that department.
3. If the Prime Minister's office shall fall vacant, a deputy prime minister, as provided by law, shall serve as acting prime minister, and Parliament shall elect a new Prime Minister within seven days, unless the office falls vacant within 14 days of a general election.
3. Should the position of Leader of the Opposition fall vacant, the same rules as above shall apply, save that the Speaker, and not the Prime Minister, shall appoint an acting Leader of the Opposition.
4. Should the Speaker's office fall vacant, Parliament shall elect a new speaker as soon as is practicable; and the Speaker may appoint a deputy to act in his or her absence; and the deputy Speaker shall preside over Parliament until it elects a new permanent Speaker; but the deputy may not be a Cabinet member, justice of the Supreme Court, Leader of the Opposition or an administrator of elections.
5. The person elected to fill the vacancy of an individual office shall serve until the next general election; however, if the whole Cabinet resigns, or is defeated on a vote of confidence, then new general elections shall be held immediately.

This is to clear up a gap I left when I wrote the Constitution, especially now that the Immigration Minister has resigned. I need a majority of the Cabinet or 8 non-Cabinet members to endorse this amendment before I can put it to a vote; signify endorsement in your replies.

Chups.

Thanks, Headpiece, but I need the majority of the Cabinet. Since there's 12 ministers (not counting the Speaker and the Leader of the Opp.), I need 7, including me.

Added a sentence dealing with what happens when the PM's office falls vacant.

I keep thinking of new things I need to clarify in the Constitution, so I've made some more changes to the proposed amendments. Please review.
