THE CONSTITUTION OF CANADA

Preamble

We the nations of Canada, in order that we may establish and preserve democracy, justice and peace in our great nation, do hereby establish and enact this Constitution of Canada.

Article I

1. Canada shall be a constitutional monarchy, with Elizabeth II, Queen of Great Britain and Northern Ireland, as Queen of Canada and Head of the Commonwealth.
2. Canada shall consist of all nations resident in the region of Canada, save those nations that are ambassadors of other regions.
3. All such nations shall be citizens of Canada, entitled to the rights and privileges of the same.
4. The sovereignty of the nation is vested in the nations of Canada as a whole.
5. The official languages of Canada are English and French.

Article II

1. The Canadian Charter of Rights and Freedoms shall apply throughout Canada, and no Cabinet or Parliament may enact any law inconsistent with its provisions.
2.The Attorney-General of Canada shall provide a link to a copy of the Charter, or post a copy of the Charter on the regional Web site.
3. The Canadian state shall have no established religion.
4. The right of any Canadian citizen to the pie, cake or other dessert of his or her choice shall not be abridged.
5. The right of Canadians to smoke marijuana shall not be abridged, and the government is hereby mandated to grow and sell marijuana to the Canadian people.

Article III

1. The legislative power of the region of Canada shall be vested in a Parliament, which shall consist of all the nations currently resident in Canada, excepting ambassadors from other regions.
2. All laws, UN Resolutions, taxes, appopriations and treaties must be approved by the Parliament before becoming law ,and laws shall be deemed passed if they receive a majority of those members voting.
3. Parliament shall vote by means of polls established on the regional Web site.
4. Parliament shall make its own rules of conduct and elect, every two months a Speaker, who shall maintain order in the Parliament and enforce said rules, and who may attend, but not vote in, Cabinet meetings.
5. No one may be punished for what they say in Parliament, unless they have violated the rules of conduct, in which case they shall be punished by the Speaker according to the aforementioned rules.
6. Parliament may question any minister about the perfomance of his or her duties.
7. Parliament alone can declare war.

Article IV
1. The executive power shall be vested in a Cabinet of Canada.
2. The Cabinet shall consist of the Prime Minister, the Attorney-General, and such other officers as Parliament may by law provide.
3. Parliament shall elect the Cabinet of Canada every two months, and the Cabinet shall serve for the length of that term, or until the Parliament withdraws confidence from it.
4. Should Parliament determine that it no longer reposes confidence in the Cabinet or in an individual minister (s), it may remove its confidence by a vote of censure, in which case new elections must be held for the Cabinet or for the individual office (s).
5. Parliament shall elect a Leader of the Opposition for a term of two months.
6. In electing the Cabinet officers, Parliament shall appoint one of its members who is not a candidate to set up the polls and announce the results; and he or she shall be named an administrator of this Web site.
7. The Cabinet shall execute the laws of the nation in accordance with the Constitution, command its armed forces and intelligence services through the appopriate ministers, and appoint ambassadors.
8. The Cabinet shall meet in public forums, unless public security requires that it meet privately; if the Cabinet should need to take a vote on an issue, it shall do so by polls in the secure forum.
9. The functions and powers of each Cabinet minister shall be set forth in a brief law to be drafted by the Cabinet.

Article V

1. The UN Delegate possesses the following powers:
a) the power to exercise the national vote on UN resolutions
the power to endorse proposed UN resolutions
c) the power to expel nations from Canada
d) the power to remove nations from the ban list
e) the power to password the region
f) the power to alter the factbook entry
2. The UN Delegate shall only vote on UN Resolutions in accordance with the will of Parliament.
3. The UN Delegate shall only expel member states, or remove them from the ban list, upon the recommendation of the appropriate minister, as determined by law
4. The UN Delegate shall only password the region upon the recommendation of the appropriate minister as determined by law
5.The UN Delegate may alter the factbook entry and endorse proposed UN resolution on his or her own recognizance.
6. If the UN Delegate does not hold a Cabinet office, he or she shall be considered a Cabinet officer by virtue of being delegate.

Article VI
1. There shall be a Supreme Court of Canada, consisting of a Chief Justice and two other Justices.
2. The Chief Justice and other Justices shall be appointed by the Cabinet, and serve as long as they exhibit good behaviour.
3. The Supreme Court shall hear all cases under this Constitution, including appeal from decision of the Cabinet concerning expulsion, removals from the ban list or passwording.
4. Parliament may remove Justices on address, by a three-quarters majority of those voting.

Article VII
1. Amendments to this Constitution may be proposed by:
a) a majority of the Cabinet
b)any 8 member nations that are not members of the Cabinet.
2. Parliament may amend this Constitution by a two-thirds majority of those voting.

This document will need to undergo some revisions, to reflect the current Government of Canada.

I agree. I would suggest we scrap it for now, and replace it with something far more basic and simple. We need a less rigid document at this time.

I'd propose something that is bare bones - listing when elections are to be held, what positions are to be part of cabinet, simple election rules, and a simple amending formula.

Here is a simple draft constitution for everyone's consideration. It is no work of art, but should get a stable but flexible set of rules in place if we ever decide to restart the Regional Government.

Constitution of the Region of Canada

I – Elections

1. Elections shall be held every two calendar months. The Elections shall be organized by the Minister of Regional Affairs. They shall take place on the Regional off-site Board. The elections shall elect members to Cabinet, as outlined in Article II.

2. Subject to paragraph 3, all leaders of nations residing within Canada, regardless of UN status, shall be entitled to vote.

3. Notwithstanding paragraph 2, Leaders of more than one nation within Canada shall be restricted to a single vote.

4. The voting period of Elections shall commence at 8:00 a.m. on a Thursday, and end at 11:59 p.m. Eastern Time on the following Sunday.

5. It is acknowledged that Regional Elections shall have no effect on the selection Canada’s Regional Delegate. It is acknowledged that the Regional Delegate shall continue to remain elected by virtue of the processes in place at the www.nationstates.net website.

6. Only those members who are registered as members of the Regional off-site Board when the polls open shall be entitled to vote. Members who register after the polls open shall not be able to vote until the next set of elections takes place in two months time.

7. Where there is a tie, the Prime Minister shall have a tie breaking vote.

II – Positions in Cabinet

1. The following positions shall make up the cabinet. Each noted position shall have the duties listed herein;

(a) Minister of Foreign Affairs
The Minister of Foreign Affairs shall be responsible for maintaining and establishing diplomatic ties with other regions. If the Minister so wishes, the Minister may establish embassies and hire ambassadors to other regions at Nation States.

The Minister of Foreign Affairs, shall ass Minister of Defence with the coordination of the Dogs of War alliance.

The Minister of Foreign Affairs shall be responsible for amassing foreign civilian Intelligence.

(B) Minister of Defence
The Minister of Defence shall be responsible for readying Canada’s nations for military roles, whether it be in defence of the Region, or in a military or occupational struggle in other regions.

The Minister of Defence shall be the director of the Dogs of War Alliance.

The Minister of Foreign Affairs shall be responsible for amassing foreign military intelligence.

© Minister of Regional Affairs
The Minister of Regional Affairs shall be in charge of communicating with all member nations of Canada. The Regional Affairs Minister shall inform member nations of events of significance, including, but not limited to upcoming UN resolutions. The Regional Affairs Minister shall seek and gauge regional opinion on issues of importance based on both formal and informal polling methods. The Minister of Regional Affairs shall be responsible for amassing domestic intelligence. The Minister of Regional Affairs shall be responsible for organizing all elections and referenda. The Minister of Regional Affairs shall be given Administrator positions on the Regional off-site Board.

(d) Minister of Doughnuts and Beer
The Minister of Doughnuts and Beer shall be responsible for the preservation of Canadian culture. The Minister of Doughnuts and Beer shall roam the region and promote unique aspects of Canadian culture. The Minister of Doughnuts and Beer shall be expected to make one post per week on a cultural topic, such as a review of a specific beer, or assessment of local doughnut chains.

(e) Minister of Justice
The Minister of Justice shall draft laws and UN resolutions at the request of Cabinet, or on its own initiative. All UN resolutions drafted may be listed for proposal without Cabinet approval or a vote. However, all laws drafted must be approved by a vote of the Cabinet. The Minister of Justice shall administer the Regional dispute resolution tribunal.

(f) Prime Minister
The Prime Minister shall be the sitting UN Delegate of the region, and shall be elected through the UN Delegate election mechanisms already in place at the www.nationstates.net website. The Prime Minister’s responsibilities shall be restricted to those responsibilities given to it at Nation States. The Prime Minister shall be given Administrator privileges on the Regional off-site Board.

2. Each Cabinet Minister will be able to appoint a Deputy Minister, who shall take the Minister's place on an interm basis should the elected Minister be unable to continue holding office. Where a Minister fails to hold office and no Deputy Minister has been appointed, the Prime Minister shall appoint a Deputy Minister until the next elections.

III Amending Formula
1. This Constitution shall only be amended upon a resolution achieving:
(a) Majority support in a Cabinet Vote; and
(B) Majority support in a special Referendum of all Regional Members, in accordance with the rules of Article I above.

It may be a draft but it looks like it could work and it'll most likely work better than the old elections and cabinet.
