with the right moves, you can use something as crappy as a Pokeball. luck is also involved.

i finally got my copy of sapphire but not up to kyogre yet :P in ruby i used ultra balls for groudon..... one in fact :P guess who is a fluke artist :P

All you need to do is simply disable the pokemon. first sleep it, then batter it down, and finally, while it's still asleep, hit it with an ultraball... it's captured, no hassle, no problems.

It might not be that easy, but that might work. It wasn't too hard, but it wasn't too easy for me.

Actually, the sleep condition is really nice. When I played with the wild Rayquazza just to see what it was like, I tried paralyzing it. Naturally, it used Rest, and recovered from Paralysis. The cool thing was that I caught it just by throwing ONE ultra ball at it while it was asleep. It's hp was still green, at about 2/3. It was that easy.
Of course, it might be a bit difficult to put Kyogre to sleep before it faints your sleeper, but hey, it's easy after that. I find the sleep condition has been way too over-powered in regards to catching. Rayquazza was supposed to be the hardest Poke to catch! It was almost the easiest. (Those Regi are mine.... *chuckles to self*)
